Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and BBJCreative LLP, the operator of GuestNet. Please read them carefully, especially sections 7 (your network and security), 10 (disclaimers), 11 (limitation of liability) and 12 (indemnity). They limit our liability and set out responsibilities that are yours.
1. About us and these Terms
1.1 GuestNet, meaning the website guestnet.my, the web app app.guestnet.my and related services (the "Service"), is operated by BBJCreative LLP, a limited liability partnership registered in Malaysia (LLP No. [LLP registration number]), [registered business address], Malaysia ("we", "us", "our").
1.2 By creating an account, ticking the acceptance box, or using the Service, you agree to these Terms and our Privacy Policy, which forms part of these Terms. If you do not agree, do not use the Service. Your acceptance is recorded electronically and is valid and binding under the Electronic Commerce Act 2006.
1.3 "You" means the person using the Service and the business or organisation they register or act for. If you act for a business, you confirm you are authorised to bind it, and the business is bound by these Terms.
2. Eligibility and business use
2.1 You must be at least 18 years old and able to form a binding contract.
2.2 The Service is provided to businesses and organisations (such as cafes, restaurants, shops, hotels and venues) for business purposes. You confirm that you acquire and use the Service for the purposes of a business. To the maximum extent permitted by law, the Consumer Protection Act 1999 does not apply to your use of the Service.
3. Your account
3.1 You must give accurate information and keep it up to date.
3.2 You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at sales@bbjcreative.com if you suspect unauthorised use.
3.3 One account belongs to one business. You may not sell, transfer or share your account, or create multiple accounts to get around plan limits.
4. The Service and plans
4.1 The Service lets you create, design and export printable cards showing a QR code that encodes the details of a WiFi network you provide.
4.2 Free plan. The free plan is provided free of charge, with the limits shown on our pricing section. At the time of writing these are: 3 cards; A5 poster format; limited fonts and colours; and a "Powered by GuestNet" line on exports, which you must not remove, obscure or alter.
4.3 Paid plans. Paid plans (such as Pro and Supporter) unlock additional features described on our website at the time of purchase. Features marked "launching soon" or similar are not yet available and are not promised until they are offered for sale.
4.4 "One-time" means no recurring subscription. A one-time purchase gives your account access to the features of that plan for as long as we operate the Service, or that plan or feature. It is not a promise that the Service or any feature will be offered forever. We may change, add or remove features, formats, fonts, limits and designs, provided we do not materially reduce the core features of a paid plan you have bought, except where required for legal, security or technical reasons or under section 13.4.
4.5 We may use third-party services (for example, hosting, network and payment providers) to provide the Service. We are not responsible for their acts or omissions beyond our reasonable control.
5. Fees, payment and refunds
5.1 Prices are shown in Malaysian Ringgit (RM) and include any applicable taxes unless stated otherwise. If Sales and Service Tax or another tax becomes payable, we may add it as required by law.
5.2 Payments are processed by our payment providers (such as Billplz or Stripe) under their terms. We do not receive or store your card or bank details. Your plan is activated once payment is confirmed to us.
5.3 Refunds. Paid plans are digital services made available immediately on payment. Except where required by law, or where a paid plan you bought cannot be delivered because of our fault, payments are non-refundable. If you believe you were charged in error, contact us within 14 days of payment and we will review it in good faith. If we discontinue the Service entirely within 12 months after your purchase, we will offer a pro-rated refund of the one-time fee, calculated over 12 months.
5.4 Chargebacks or payment reversals made without first contacting us may result in suspension of paid features while the matter is resolved.
5.5 We may change our prices at any time. Changes do not affect plans you have already paid for.
6. Your content
6.1 "Your Content" means everything you put into the Service: business name, card text, network names, logos, images, designs and the WiFi details used to generate QR codes. You keep ownership of Your Content.
6.2 You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, resize, render and display Your Content, only as needed to provide, secure and improve the Service for you. This licence ends when Your Content is deleted from the Service, except for copies we must keep by law or which remain in backups for the retention periods in our Privacy Policy.
6.3 You promise that:
- you own Your Content or have all rights, licences and permissions needed to use it, including trademarks and logos, and to let us process it;
- Your Content does not infringe anyone's intellectual property, privacy or other rights;
- Your Content is not unlawful, defamatory, obscene, hateful, misleading or harmful.
6.4 You are responsible for keeping your own copies of exported files. The Service is not a backup or storage service. We keep only the latest export per card and format, and we may delete exports, uploads and inactive free accounts as described in our Privacy Policy and section 13.
6.5 We do not review Your Content before it is used, but we may remove or disable content that we reasonably believe breaches these Terms or the law.
7. Your network, security and guests
7.1 You must only create cards for WiFi networks you own or are authorised to share.
7.2 Anyone who can see or scan a card, or obtain an exported file or its link, can read the network name and password and join the network. A QR code does not hide or protect the password. You choose where you display cards and who can access exported files, and you accept that risk.
7.3 You are solely responsible for:
- your network, router and internet service, and their configuration and security;
- who accesses your network and what they do on it;
- your compliance with laws that apply to providing WiFi to the public, including the Communications and Multimedia Act 1998 and the Personal Data Protection Act 2010, and with your internet service provider's terms.
We strongly recommend a separate, isolated guest network, WPA2 or WPA3 security, and changing the guest password periodically.
7.4 GuestNet does not provide internet access, operate or monitor your network, collect data from your guests, or control what happens after a guest scans a card.
7.5 Test before you print. You must check that each card scans and connects correctly on the devices your guests are likely to use before printing or displaying it. Whenever your network name, password or security type changes, you must re-export and replace your cards.
8. Acceptable use
You must not, and must not let anyone else:
- use the Service for anything unlawful, fraudulent or harmful, or in breach of these Terms;
- create QR codes or cards intended to deceive or harm people, for example cards that imitate another business's network ("evil twin" networks), phishing, malware distribution, or networks set up to intercept guests' traffic;
- upload content that infringes rights, contains malware, or is unlawful or offensive;
- try to gain unauthorised access to the Service, other accounts or our systems; or probe, scan or test their vulnerability without our written permission;
- interfere with or disrupt the Service, overload it, or get around rate limits, plan limits or security features;
- remove or alter the "Powered by GuestNet" line on free-plan exports, or otherwise misrepresent your plan;
- copy, scrape, reverse engineer, decompile or create derivative works of the Service, except as allowed by law;
- resell, sublicense or offer the Service to third parties as a service, without our written agreement;
- use automated means to create accounts or cards in bulk.
9. Our intellectual property
9.1 The Service, including its software, templates, designs, text, graphics, the GuestNet name and logo, is owned by us or our licensors and protected by law. Apart from the limited right to use the Service under these Terms, no rights are transferred to you.
9.2 Subject to these Terms and your plan, you may print, display and share the cards you export for your own business.
9.3 Fonts in the Service are provided under their own open licences. If you give us feedback or suggestions, we may use them freely without obligation to you.
10. Disclaimers
10.1 The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions and representations, whether express, implied or statutory. These include any implied terms of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.
10.2 In particular, we do not warrant that:
- every QR code will scan or connect on every phone, operating system, camera app or network configuration;
- printed output will match on-screen colours or sizes;
- the Service will be available at any particular time, or be free from viruses or security vulnerabilities;
- content, guides or information on our website are complete, current or suitable for your situation. Guides are general information, not professional, technical, security or legal advice.
10.3 Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded.
11. Limitation of liability
11.1 To the maximum extent permitted by law, we and our partners, employees, agents and suppliers will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:
- indirect, incidental, special, consequential, exemplary or punitive loss or damage;
- loss of profits, revenue, business, goodwill, customers or anticipated savings;
- loss or corruption of data or content;
- unauthorised access to or use of your network, devices or internet service, or any act or omission of anyone who connects to your network;
- costs of printing, reprinting, materials or substitute services;
- loss arising from your failure to follow section 7 or from exported files or links you shared or displayed;
This applies even if we were told such loss was possible.
11.2 To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of: (a) the total amounts you paid us for the Service in the 12 months before the event giving rise to the claim; and (b) RM100.
11.3 Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
11.4 Any claim relating to the Service must be brought within one (1) year after the cause of action arises, to the extent permitted by the Limitation Act 1953 and other applicable law.
12. Indemnity
You agree to indemnify, defend and hold harmless BBJCreative LLP and its partners, employees, agents and suppliers against all claims, demands, losses, liabilities, damages, fines, costs and expenses, including reasonable legal fees, arising out of or related to:
- Your Content;
- your network and anyone's use of it;
- your breach of these Terms or of any law;
- your infringement of any third party's rights.
13. Suspension and termination
13.1 You may stop using the Service and delete your account at any time in Settings. Deletion is permanent and removes your cards, uploads and exported files.
13.2 We may suspend or terminate your access, with or without notice, if:
- you breach these Terms;
- your use creates legal, security or reputational risk for us or others;
- we are required to by law or a competent authority;
- payment is reversed or fraudulent.
If we terminate a paid account for your breach, no refund is due.
13.3 We may delete free accounts that have been inactive for more than 24 months, after giving at least 30 days' notice to the account email.
13.4 We may discontinue the Service or any part of it. We will give at least 30 days' notice where reasonably possible, so you can download your exports, and section 5.3 applies to recent paid purchases.
13.5 Sections 6.4, 7, 9 to 12, 15 and 16, and any other terms which by their nature should survive, survive termination.
14. Changes to the Service and these Terms
We may update these Terms from time to time. We will post the new version here with a new date. If the changes are material, we will give you reasonable notice by email or in the app before they take effect. Continuing to use the Service after changes take effect means you accept them. If you do not agree, you must stop using the Service and may delete your account.
15. Governing law and disputes
15.1 These Terms, and any dispute or claim arising out of or in connection with them or the Service, including non-contractual disputes, are governed by the laws of Malaysia.
15.2 Before starting formal proceedings, please contact us at sales@bbjcreative.com so we can try to resolve the dispute informally. Both parties agree to negotiate in good faith for at least 30 days.
15.3 Subject to 15.2, the courts of Kuala Lumpur, Malaysia have exclusive jurisdiction, except that we may seek urgent injunctive relief in any court of competent jurisdiction.
16. General
16.1 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. They replace any earlier understanding.
16.2 Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms remain in effect.
16.3 No waiver. Our failure to enforce a right is not a waiver of it.
16.4 Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or to a successor of the Service or our business.
16.5 Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control. These include natural disasters, epidemics, power, internet or hosting failures, cyberattacks, government actions and failures of third-party providers.
16.6 Notices. We may give notices by email to your account address or in the app. You give notices to sales@bbjcreative.com. Electronic notices satisfy any requirement for notice in writing.
16.7 Relationship. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between you and us.
16.8 Third parties. No one other than you and us has any right to enforce these Terms.
16.9 Language. These Terms are written in English. If they are translated, the English version prevails to the extent permitted by law.
